Moneylending and the Law

FLAC has updated its booklet on moneylending and the law. The law around moneylending is dealt with by the Consumer Credit Act 1995. This Act gives you the borrower many rights, as well as placing obligations on the moneylender. It also makes certain practices illegal. Habitual Residence Condition

FLAC has produced a briefing paper on Habitual Residence to update people on how the HRC is being applied to certain groups (issued September 2009). It summarises the effect of four recent decisions by the Chief Social Welfare Appeals Officer, which rejected an argument by the Department of Social and Family Affairs that no-one in the asylum/protection/leave to remain process can satisfy the HRC, which is a pre-condition for receiving social welfare payments.

Civil Legal Aid

FLAC's Fact Sheet provides information on how a person may qualify for legal advice and/or legal aid under the Legal Aid Board's civil legal aid scheme. In order to obtain Legal Aid, a person must have (1) limited means, (2) merit to their case and (3) their case must not be one of the categories excluded by the Legal Aid Act. FLAC legal information leaflets

FLAC has produced a range of information leaflets on various areas of law that cover the basic information in each area, explaining how the law works. The leaflets are available to download (in PDF format) below and are also available in print format from Citizens Information Centres around the country as well as from the FLAC office.
